By accessing or using californiamedicalmarijuanacard.org (the "Site") or any of the services offered through the Site (the "Services"), you agree to be bound by these Terms of Use, our Privacy Policy, and all applicable laws. If you do not agree, please discontinue use of the Site.
You must be at least 18 years of age and a legal resident of California to request a medical cannabis evaluation through this Site. By using the Services, you represent that you meet these requirements and that all information you provide is accurate and complete. Patients under 18 may use the Site only through a parent or legal guardian acting as primary caregiver.
The Site connects California residents with licensed physicians who may, in their independent medical judgment, issue a medical cannabis recommendation under California's Compassionate Use Act and SB 420. The Site itself does not provide medical care and is not a substitute for a relationship with a primary care provider. Issuance of a recommendation is at the sole discretion of the evaluating physician.
While many patients qualify, approval is never guaranteed. The physician will issue a recommendation only if, in their professional judgment, medical cannabis is appropriate for your condition. By scheduling a visit, you consent to receive medical evaluation by secure audio and video telehealth, in accordance with California Medical Board telemedicine standards and federal HIPAA requirements. You understand that telehealth has limitations and that the physician may, at their discretion, require an in-person evaluation in certain cases.
You agree to provide truthful, accurate, and complete information during your evaluation. Misrepresenting your identity, residency, age, or medical history may result in cancellation of your evaluation without refund and may be reported to state authorities where required by law.
All fees are stated in U.S. dollars and are due at the time of booking. If the physician does not approve a recommendation, you are entitled to a full refund of the evaluation fee under our money-back guarantee. Refunds are processed to the original payment method within 5 to 10 business days. Fees for optional add-ons (plastic card, grower's letter, expedited shipping) are non-refundable once the item has been produced or shipped.
You agree not to use the Site or Services in any way that could damage, disable, overburden, or impair the Site or interfere with any other party's use. You agree not to attempt to gain unauthorized access to any portion of the Site, including patient records or physician accounts. You may not use any automated means to access the Site without our prior written consent.
All content on this Site, including text, graphics, logos, and software, is the property of California Medical Marijuana Card or its content suppliers and is protected by U.S. and international copyright laws. You may not copy, reproduce, modify, or distribute any portion of the Site for commercial purposes without our prior written consent.
The Site may contain links to third-party websites operated by independent parties. We are not responsible for the content, accuracy, or practices of these sites. Inclusion of a link does not constitute endorsement.
The Site and Services are provided on an "as is" and "as available" basis. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Site will be uninterrupted, secure, or error-free.
To the fullest extent permitted by law, California Medical Marijuana Card, its physicians, officers, employees, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Site or Services. Our total liability for any claim arising from these terms or your use of the Site is limited to the amount you paid to us in the 12 months preceding the claim.
You agree to indemnify and hold harmless California Medical Marijuana Card and its affiliates from any claim, demand, loss, or expense (including reasonable attorney's fees) arising from your use of the Site, your violation of these Terms, or your violation of any rights of any third party.
Cannabis remains a Schedule I controlled substance under the federal Controlled Substances Act. State medical cannabis laws apply only within state borders. You are solely responsible for understanding the federal and state implications of cannabis use, including but not limited to firearms ownership, professional licensing, employment, and travel.
These Terms are governed by the laws of the State of California, without regard to its conflict of laws principles. Any dispute arising out of these Terms or your use of the Site shall be resolved exclusively in the state or federal courts located in California.
We may update these Terms from time to time. The "Last updated" date at the top of this page indicates when the Terms were last revised. Continued use of the Site after changes are posted constitutes acceptance of the revised Terms.
